All this shit's important but let me tell you why we're gonna focus on the judges and the tax levy locally. Local elections are important because they affect our daily lives! IAC is here to connect these decisions to the real world. This section focuses on Cuyahoga County's specific elections and gives you some examples of how these positions can relate to you.

FOCUS ON LOCAL.

COURT OF COMMON PLEAS

GENERAL

Hears criminal and civil cases. Criminal cases happen when someone breaks a law or commits a crime, that results in jail time. Civil cases handle almost all other disputes and aim for some sort of recovery. This division has original jurisdiction in all criminal felony cases and in all civil cases in which the amount in controversy is more than $15,000. A criminal case is filed by the government and is led by a prosecuting attorney. A civil case is filed by a private party, an individual or corporation, against another individual or corporation.

HOW DOES THIS RELATE?

  • You are charged with breaking and entering.  Your case will be tried in the general division.

  • You can file or be tried in a civil lawsuit in cases such as disputes related to money, debts, property and personal injury.

DOMESTIC

Presides over domestic cases such as dissolutions, legal separations, annulments, divorces, and violence petitions. As well as, child custody and child support cases.  Four judges

HOW DOES THIS RELATE?

  • You decide you want to get divorced.  You must apply for a divorce with the domestic relations court.  

  • You want shared custody of your child.  You must file a motion in the domestic relations courts.

  • You believe you are overpaying in child support.  You want to have the judgment re-evaluated.  You file a motion to have your case heard in this court.  

PROBATE

Presides over marriages, getting an error corrected on a birth certificate as well as wills and Estates Guardianship, Name changes, Adoptions (1 yr older). Probate judges are judicial officials who oversee the administration of estates, as well as adoptions, guardianships, and other legal matters. They also issue marriage certificates or grant name changes.

HOW DOES THIS RELATE?

  • All of your life you used your mom’s maiden name as your last name. You decide you want to legally add your father’s name to your last name. You handle this process through the probate division of the Court of Common Pleas.

  • A loved one passes away without a will. The basic role of the probate court judge is to assure that the deceased person's creditors are paid, and that any remaining assets are distributed to the proper beneficiaries. 

  • You decide to get married.  You must apply for a marriage license with the probate court.

PROPOSED TAX LEVY

ISSUE 68

(Renewal and Increase-CMSD)

A proposed levy to renew and increase property taxes for CMSD.

HOW DOES THIS RELATE?

  • A yes vote:  Currently, property owners are paying $150 per year for properties assessed at a value of $100,000.  If this levy passes, property owners will pay $200 per year for the next 10 years. The increase will go into effect January 2021.  

  • A no vote:  Opposes renewing and increasing the property tax to fund the Cleveland Municipal School District, thereby allowing it to expire in 2020.
